Ephedra is a plant that was discovered and used in places such as Asia and the Orient thousands of years ago. This plant became popular because of its ‘medicinal benefits’ and was known for its ability to improve energy levels and promote weight loss. Of course, these benefits couldn’t go untapped in the Western world, and over the years Ephedra has become widely available in supplement form, and has flown off the shelves. This supplement is classed as just that – a supplement, which meant that for many years the Food and Drugs Administration had no authority over ephedra products.
However, by 1997 many reports of adverse health effects and even reports of death had started to roll in - and they had one thing in common…ephedra. Following this, The FDA did try and intervene in 1997. The FDA initiated a proposal that not only put strict rules on the labelling of Ephedra and other similar supplements, but also limited dosage and the duration over which Ephedra was taken. However, the supplement industry strongly opposed the proposal, and this led to a thorough examination of the FDA’s proposal by the government.
The controversy continued as it was finally decided that the FDA did not have enough evidence of ill effects to limit dosage or dictate the duration over which the drug should be taken, and this part of the proposal was dropped. Even this did not bring the matter to an end, as the supplement industry continued to fight for the right to have the strict labelling on ephedra scrapped. Fighting the other corner were watchdog groups such as Public Citizen, demanding that ephedra be banned altogether.
In a turn of events in 2004, Ephedra was indeed banned altogether. However, the jubilance of opposers of the supplement and consumer watchdog groups was not to last long – a year later, a judge overturned the ban and stated that the FDA had to provide more proof that 10mg or less of Ephedra per day could cause damage. Until then, the ban was to be lifted.
Some of the side effects that have been linked with Ephedra include:
Legal action
Anyone that has suffered from side effects as a result of taking Ephedra could be entitled to compensation. However, it is important to remember a couple of crucial facts when considering legal action. Firstly, each state operates statutes of limitation, which place deadlines on the time that you have to take legal action. It is therefore vital that you take action quickly or you may find yourself no longer eligible to make a claim. Secondly, the supplement industry is a booming one, and the companies that manufacture ephedra supplements will have the cash and the resources to employ the very best to fight their case. You therefore need to ensure that you put up a good fight by enlisting the help of an experienced and specialist Ephedra lawyer.
A lawyer that has experience and expertise in the area of Ephedra litigation will be able to fight your corner admirably, increasing your chances of getting compensation for any personal injury sustained as a result of taking Ephedra. An Ephedra attorney will be well versed when it comes to the history, the side effects, and the facts surrounding Ephedra, which means that he or she can put this knowledge and skill to good use to help your case.
