Appeal Denied For Mentally Retarded Convict
A mentally retarded convict awaiting the death penalty in Texas has been refused an appeal hearing in a catch-22 situation whereby his attorney missed the filing deadline by one day. The US Supreme Court has placed a ban on the death penalty for a mentally retarded convict, but the judge has still denied the appeal.The decision read: "However harsh the result may be -- particularly in a death penalty case involving a petitioner who has made a prima facie showing of mental retardation -- Congress acted deliberately in enacting a strict limitations period."
Attorneys for the defense state that this sort of decision could eventually result in someone that is meant to be exempt from the death penalty getting executed due to a simple technicality. One lawyer stated: "It's a very difficult situation. It was based on a technicality."
The defendant was sentenced in 1992 at the age of 34 for abducting and shooting a 21 year old man. He is still awaiting an execution date.
