The plaintiff could now be set to receive million of pounds in compensation after the High Court ruling that stated staff at Whipps Cross Hospital acted negligently after Daniel’s mother complained of abdominal pains while she was still pregnant with him. She allegedly told doctors that the baby had stopped moving. This was just a few months before the due date.
Reports state that tests were carried out but Daniel’s mother was sent home. However, tests carried out at a later date showed that the unborn child was at risk of being born with defects. He was born in 1984 with cererbral palsy.
The judge dealing with the case stated that when Daniel’s mother complained of abdominal pains she should have been kept in at the hospital, even after the tests, rather than being sent home, and the birth of the baby should have been brought forward.
