UK Company Fined Over Accidents
A company in the UK has been fined nearly two hundred thousand GBP after failing to heed the advice of the UK’s Health and Safety Executive, which allegedly resulted in accidents that led to two people having to have hands amputated. The company, Kubota UK, which deals with agricultural machinery, was fined one hundred and seventy five thousand GBP and had to pay over twenty thousand GBP in court costs.In 1999 the UK’s Health and Safety Executive warned the company that one of its products, a grass collector with a sharp blade, had ended up injuring someone. The company was advised by the HSE to look at making improvements to the product to incerase safety. However, it seems that these recommendations were not heeded by the company.
As a result of the failure to follow the advice of the HSE, it is claimed that two people lost their hands as a result of the product. One man had to have a hand amputated in 2003 after operating the grass collector. Another man had to have part of his hand amputed the following year after using the product. A defect in the machinery allowed users to put their hands inside the collector, which resulted in the accidents.
The judge dealing with the case stated: "The risk of injury to respective victims was obvious, foreseeable and continuing over a prolonged period. It seems to me that there can be no doubt that the defendant could and should have taken steps - which they took to protect operators in 2004 - in 1999 and if they had done then the accidents would not have occurred."
