According to reports this is the first such action to be taken against the NHS helpline, and the plaintiff, Kerry Robertson from Aberdeenshire is looking to claim seven hundred and fifty thousand pounds in compensation. The NHS Helpline did not comment on the legalities of the case due to pending action, but did confirm that since the death of Mr. Wiseman the service had improved.
According to the reports Miss Robertson called the NHS Helpline on three occasions over a three day period before Mr. Wiseman passed away. The report goes on to state that the helpline advisers said that it sounded like flu. However, he was later taken to hospital where he died from toxic shock.
Miss Robertson went on to say: "Money's not important although it's going to help the kids. It's just the fact that we haven't had an acknowledgement from NHS 24 to say that they were in the right or the wrong and we've had no apologies. And they've stated that they don't want to make an apology because they think that they haven't done anything wrong."
