
An original ruling was made by a Cook County circuit judge, which agreed with the defendants in the case. This previous ruling meant that because Roop had filed for bankruptcy he didn’t have the right to sue, and that this would have to be done by the estate trustee because the action would be part of the bankruptcy estate.
However, the plaintiff’s argument was that only assets acquired as part of a lawsuit prior to bankruptcy would come under this estate rather than assets acquired after filing, and the Appellate Court agreed with this argument.
Justice John Tully, who wrote the Appellate Court order, wrote: "Finally, the public policy upon which Chapter 7 is based, which is creating a 'fresh start' for debtors, further supports the view that the date of filing the Chapter 7 bankruptcy petition rather than the date of the discharge in bankruptcy should be the date used for determining what property is included in the Chapter 7 bankruptcy estate."
