Prisoners Can Continue With Lawsuit Over Being Overcharged On Phone Calls
Despite having their original lawsuit dismissed, prison inmates now feel optimistic again after a New York court of appeals ruled that they can continue with their lawsuit, which claims that the state has been overcharging them on phone calls for years. If successful, prisoners and families could claim back some of the costs going back a great period of time.The original lawsuit was dismissed by a lower court, which stated lack of timeliness as the reasons for the dismissal. However, this decision was overturned by the Court of Appeals, which has said that the case will now go to trial although there is still no guarantee that the inmates will be successful.
According to prison advocates prisoners are being charged six hundred and thirty percent more on their phone calls to the outside world than the normal phone rate, with a three dollar connection charge and then charges of sixteen cents per minute.
The state had argued in the past that the lawsuit should be dismissed due to exceeding the statutes of limitations, which was four months. The State Correctional Department also argued that much of the money from calls went towards funding programs for inmates.
