Apple Sued Over iTunes Patent
Apple Computers Inc. is being sued by a businessman over the alleged theft of his design. The Chittenden County businessman filed a federal lawsuit that claimed the computer giant and manufacturer of the iPod stole his digital jukebox software design. David Contois is now seeking a court injunction to stop Apple from distributing its iTunes software.In addition to the court order, Contois is also seeking financial compensation for the alleged theft of his design, as well as legal fees from Apple Computers Inc. However, Apple is seeking payment of legal fees from the plaintiff having denied all of the allegations in the lawsuit.
A Burlington US District Court will be the venue for a preliminary hearing, where discussions will take place with regards to the details of the case and a possible decision made with regards to when it may go to trial. The lawsuit alleges that the plaintiff designed the software and exhibited it at trade shows.
The lawsuit, which was filed in June, also reads: "Apple has copied the invention. Apple's infringement has been and continues to be willful."
