Wrong Sperm Used In Fertility Mix-Up
A couple who were devastated to learn that the wrong sperm had been used in fertility treatment have filed a lawsuit against the fertility clinic where they were treated – the New York Medical Services for Reproductive Medicine.The couple, a light skinned Hispanic woman and a white man, realized something was wrong when she gave birth to a black baby. At first the doctors claimed that it was nothing to worry about and that the baby would lighten over time. However, it turned out that although the mother’s egg had been used, the father’s sperm had not, and instead the sperm of an unknown African American man had been used.
The lawsuit claims that as a result of the blunder Jessica (the baby) "…will never know or be able to determine the identity of her actual father, and will consequently never be able to know her full medical history and condition."
The lawsuit also highlights the concern about where the father’s sperm has gone, and whether it has been used in another fertility treatment with someone else. The suit stated: "There is continuing uncertainty . . . as to whether the genetic material of either or both of them has been inappropriately used for others and that they may have natural children or half-children that they are unaware of."
