Reserve Officer Files Lawsuit Against City
A reserve police officer for the District of Columbia has filed a lawsuit against the city of Laurel, claiming that in 2006 a Laurel police officer accused him of impersonating an officer. As a result of the charges, which were dropped at the end of the year, the plaintiff, Chauncey Payne, was put in prison in Prince George’s County Jail for a night.Payne, who has been serving with the reserve police since 2003, filed his lawsuit at the US District Court in Maryland. Payne, who works on a full time basis as a math teacher, is seeking unspecified compensation, and accuses the city of false arrest and imprisonment, reckless endangerment, defamation of character, and malicious prosecution.
An attorney for the plaintiff said that the incident began when Payne warned a woman driver about having expired tags on her car. He told the woman that her vehicle could be towed, and he was wearing his uniform at the time of the incident.
The woman subsequently complained to police, and following an investigation the police arrested Payne for stalking and for impersonating a police officer. The Laurel police officer was provided with a copy of Payne’s badge but continued with the arrest, states the lawsuit.
