Woman Files Lawsuit Against Police Officer And City
A woman has filed a lawsuit against the city of Portland and a Portland police officer, claiming that the officer beat her when she swore at him during a traffic stop. The woman claims that she was stopped for not wearing a seatbelt, and alleges that the officer attacked her after she swore at him during the incident.Fifty-eight year-old Barbara Weich, the plaintiff in the case, filed her lawsuit earlier this month at the US District Court in Portland. Her lawsuit accuses the police officer, Gregory Adrian, and the city of Portland of using excessive force, battery, and malicious prosecution.
The plaintiff states that the incident occurred in 2005, and she had been stopped for the second time by the same police officer, who then proceeded to attack her. She claims that she suffered severe bruising as a result of the incident, and her lawyer also claims that she suffered a broken arm and head injuries as a result of the attack.
According to the police officer: "I knew that I would need to use force to get Weich to comply with me. I chose to use an arm-bar on her left arm as soon as I could. As my arms entered into the cab of the truck, I made a deliberate decision to distract Weich with a light jab to the left side of her jaw. My intention was to shock her enough to gain solid control of her left arm in a control hold before she would chose to resist or drive away. ... I did not have time to warn her of my intentions, plus desired an element of surprise for maximum effectiveness."
