Judge Will Award Damages In Age Discrimination Case
White Sands Missile Range has been found guilty of age discrimination by a federal judge after passing up two older employees for promotion in order to opt for a younger member of staff.It is claimed in the lawsuits filed that the employees were overlooked for promotion in 2003, and it is alleged that the company did this in order to deal with the problem of an older workforce.
Separate lawsuits against WSMR were filed by two employees who both alleged discrimination. The plaintiffs were Ricardo Medina and Andrus Garay. In their lawsuits the two plaintiffs claimed that the company screened applicants that were close to retirement age when it came to promotions.
It is reported that due to budget constraints the government was forced to slow down on hiring employees for a number of years in the 1980s and 1990s, leaving agencies with either older or younger employees far fewer middle aged ones.
