Inmates Join Death Penalty Lawsuit
Following the filing of a lawsuit by a death row inmate in December, another two inmates have now been granted permission to join the lawsuit by a federal judge. The lawsuit was originally filed by inmate Norman Timberlake, and the suit claimed that the lethal injection method of carrying out the death penalty in Indiana was cruel.According to the lawsuit, inmates that have already been executed using this method in the state have not been properly anaesthetized, and suit describes the death penalty method used in Indiana as ‘cruel and unusual punishment’. The suit was filed at the US District Court in Indianapolis.
Judge Richard L Young has now agreed that another two inmates, David Leon Woods and Michael Lambert, can join the case as plaintiffs. The original plaintiff was supposed to be administered the death penalty earlier this year, but the execution was stayed because the Supreme Court has yet to decide on a pending case relating to the execution of mentally ill inmates.
Two of the three plaintiffs that are now involved with the lawsuit are on death row for killing police officers in separate incidents. The third is on death row after he fatally stabbed a neighbor.
