Lawsuit Over Beach Boys Memorabilia Dismissed
A lawsuit that was filed over some memorabilia of the hit seventies band the Beach Boys has recently been dismissed by a federal judge. The lawsuit was a multi-million dollar one, and claimed that various valuable items had been stolen after being stored for safety in a warehouse. However, the judge dismissed the lawsuit through lack of proof of this theft.The group’s company, Brother Records, was told recently by Judge Manuel Real that there was not enough proof to show that the defendants "stole, misappropriated or otherwise improperly, wrongfully or illegally acquired any property." The defendants in the case were Roy A. Sciacca, Allen Gaba and Gem System Inc.
According to the lawsuit the group had stored various items in Gaba’s warehouse, and this included photos, contracts, original sheet music, and various instruments. The lawsuit goes on to state that in 1994 the band decided to clear out the warehouse only to discover that a number of boxes were missing.
A lawyer for one of the defendants, however, stated that the items that he had were all bought at auction. He said: "This has really been a difficult time for him. He's a big collector of memorabilia, and to have the Beach Boys making these kinds of allegations against him has just really, really interfered with his ability to do business."
