Judge Dismisses Lawsuit Over Murdered Pharmacist
A Baltimore federal judge has dismissed a lawsuit relating to the murder of a pharmacist in 2001, after relatives of the murdered woman filed a suit alleging that the woman could have been protected by the state had the police dispatchers on duty not messed up on the emergency call that was made to them.The judge ruled that even if the officers from Anne Arundel County had handled the call in error, the county could not be considered responsible for failure to protect the deceased. The assistant county attorney dealing with the case stated that the incident was a tragic one but that "The judge followed the law as he was bound to do."
The family of the 26-year-old pharmacist claim that a call was made to emergency services from a bystander who called from a payphone to report the woman’s abduction. However, the lawsuit alleged that the calls were improperly handled resulting ultimately in the pharmacist’s death.
Following the incident, two dispatchers from the department were fired, and blame was laid on both human error as well as on computer problems. The lawsuit was filed by the family of the deceased in 2005.
