Student Organization Sued Education Department
The United States Education Department is being sued by a student organization because of a law that is taking the rights to financial aid away from thousands of students who were convicted on drugs charges while receiving financial aid.The suit, which has class actions status, is being filed by the American Civil Liberties Union, and is on behalf of Students for Sensible Drug Policy. One of the defendants named on the lawsuit is the Secretary for Education, Margaret Spellings. The suit is being filed in federal court in South Dakota.
Three students who lost out on financial aid after drug related convictions are named as plaintiffs in the lawsuit, and altogether the suit represents around 200,000 students who lost their financial aid since 1998 due to drug related convictions.
The suit alleges that by denying the students financial aid, they are being penalized twice for the same conviction, as they will already have been punished by the courts. The suit claims that the law is therefore unconstitutional.
