Sexual Discrimination Payout For Fire Service Controller
A fire service controller who claims that his career was left in pieces after a female colleague made complaints about his conduct has been awarded one hundred thousand GBP (around two hundred thousand dollars) in compensation. John Owers worked with the Devon Fire and Rescue Service in the UK, but after a female colleague made sixteen complaints about him – none of which were upheld – he was banned from entering his own control room.Complaints included the fact that he had not attended the farewell party of another colleague, and that he should not have taken a holiday in August 2006. Ten of the sixteen complaints were so trivial that no further investigation was carried out and the complaints were not upheld. Mr. Owers claimed that he was discriminated against because of his sex, and that he had been treated as though he had done something wrong by his employer despite the fact that the complaints made by his colleague, Miss Kelly, were found to be baseless and trivial.
According to the fire service, Mr. Owers was given support during the investigations, as was Miss Kelly. Mr. Owers stated that he made his own complaints with regards to the way that he was being treated, but that no action at all was taken with regards to his complaints. Miss Kelly has left her job, and has moved abroad.
A lawyer commented regarding the case, and stated: "The case demonstrates the need for employers to have a procedure for dealing with complaints by one employee against another in a speedy and affective way. Such procedures need to provide for a proper investigation of the allegations, prompt decisions on whether the complaints have any merit and fair sanctions for complaints that are upheld. In the meantime, a temporary working solution may need to be agreed but never forget that the accused is innocent until proven guilty. As this case shows, mistakes can be costly."
