Huge Compensation Judgement Reversed By Courts
A massive compensation judgement for nearly $90 million has been reversed by the Louisiana Court of Appeals, Fifth Circuit. The judgement was made originally in favor of Kaiser Aluminium and Chemical Company, one of its employees who was injured, and the company’s insurers. It was against the Thomas and Betts Corp, an electrical products manufacturer, and was for a total of $88.75 million.The lawsuit stemmed from an incident that occurred in 1999, where there was a huge explosion at the Louisiana Kaiser plant, destroying a large part of one of its sections. Many lawsuits were filed, from the company to various employees and the insurer.
The lawsuits were then consolidated with many of the claims having been settled by the time that the case went to trial in 2001. By the time the case went to court, only Kaiser, one employee, and its insurer had not settled. Damages were awarded totalling nearly $96 million.
It is now thought that the plaintiffs will seek further appellate review after the reversal of he judgement, or in the Court of Appeal.
