Lawsuit Against Radio Station Regarding Reruns
A small radio station is being sued by CBS Radio over reruns of Don Imus programs. Imus was fired after he made racist and sexist comments about the women’s college basketball team at the Rutgers University. The radio station KCAA-AM has been accused of violation of copyright for its airing of the reruns.The lawsuit against the radio station has been filed in federal court in Riverside last week, and accuses the smaller radio station of violation of copyright protections. A hearing has been set with regards to the case, and CBS is seeking a restraining order and one hundred and fifty thousand dollars for each violation.
The smaller radio station started recently airing the reruns of the shows, and also aired reactions from audiences in the form of calls, letters, and emails. An attorney for the radio station stated that it was simply trying to educate the public with its actions. The radio station also wrote to attorneys at CBS to state that it planned to destroy all Imus material in a short while and stop the reruns.
However, in court papers CBS stated that the defendants "have made it clear ... that only a judicial decree will prevent them from persisting in their actions."
