In his lawsuit, Wilmot Lewis claims that Lori Marston struck his wife while driving a minivan in December last year. His wife, Ethel was collecting her daily newspaper from the driveway when the incident occurred. The lawsuit goes on to state that Marston then left the scene of the accident, and described her actions as "willful, wanton and reckless".
A lawyer for the plaintiff claims that the case is also still being investigated by police in the area, and that until they decide whether Marston should be charged or not they will not release any details. He stated: "They haven't decided what they're going to do with it. They certainly have information that we need."
According to reports, although Marston did stop and speak to police officers about the incident after it occurred she failed to inform them that she was the one that had actually been involved. Furthermore, her insurance company is claiming that she was not insured at the time because she missed at least one payment.
