Class Action Status Sought On Lawsuit
A class action status is being sought on a lawsuit filed against Bausch & Lomb after a woman allegedly damaged her cornea after using a contact lens solution made by the manufacturer. The class action status is being sought by a Miami attorney, who states that the woman developed an eye fungus from the solution, which scarred and damaged the cornea.A similar lawsuit has been filed in New York, and plaintiffs’ lawyers allege that the company either didn’t remove the fungus from the eye solution or that it caused it to grow during the manufacture of the solution. A fungus investigation is being carried out at the company’s Greenville manufacturing plant.
The Food and Drugs Administration had already cited the company several years ago, and this was for failure to investigate the presence of paint chips in areas where eye solutions were bottled and packaged. The paint chips were discovered during inspections.
A spokesperson for the company made no comment about the lawsuit but stated: "Obviously we're working to complete the investigation into these fungal infections as quickly as possible."
