Delay In Closing Arguments At Vioxx Trial
The closing arguments at the latest Vioxx trial in Rio Grande have been delayed, which means more waiting for the plaintiffs, the family of the late Leonel Garza, and the defendant, the pharmaceutical giant Merck. The closing arguments will now have to wait until Thursday, as one of the jurors needed time off in order to attend the funeral of a grandparent.Thousands of lawsuits are waiting to be heard against Merck over its controversial drug Vioxx, which allegedly caused a range of serious problems such as heart attacks and strokes, many of which proved fatal. Only five lawsuits have been decided to date, out of which Merck has won three and has been forced to pay out multi-million dollar compensation awards in the other two.
In this current case the decedent, Mr. Garza, died from a heart attack. He had been taking Vioxx for only a week according to Merck lawyers, who state that this was not a long enough period for the drug to have had an adverse effect, and that the heart attack was the result of existing heart problems.
The family of Mr. Garza are asking for one billion dollars. Their lawyers state that Mr. Garza was perfectly healthy and at low risk for a heart attack, and that he took Vioxx for a month before he had his heart attack.
