Man Loses Personal Injury Claim Against Denny’s
A man who was recently awarded over $40,000 in a case against Denny’s restaurant has lost the award in an appeal by the restaurant. Nathaniel Washington was awarded $40,000 for personal injury and emotional stress after finding a half eaten chicken wing in his roast dinner at Denny’s back in 1998. Mr. Washington claimed that he was ill after eating the meal, and that he has since feared for his life in case he contracts AIDS or another infectious disease from eating the meal containing the half eaten wing.However, after the judge awarded the compensation as well as a further $30,000 in attorney fees and court costs, Denny’s appealed. It was discovered that Mr. Washington had kept the half eaten meal in his freezer for all this time, but had never had it tested, which could have alleviated the fears and emotional stress. Furthermore, he had no proof that he had been affected by a disease from eating the meal, and even his doctor stated that the chances of being infected in this way were slim.
The judge has now reversed the award and the attorney and court costs. Mr. Washington also complained of racial discrimination by Denny’s, stating that he has heard of racial problems in a number of Denny’s restaurants, and also that when he and his wife ate there they had to wait for the white people that came in after them to be seated first, and then, as the only black patrons, were eventually seated. And then he stated that he went on to find the half eaten wing in his dinner, and that it had only happened to him.
