High Court To Decide On Gay Marriage Ban
The very court that once legalized gay marriage in Massachusetts is now to hear arguments and make a decision on whether this legalization should be ended, based upon opposition from voters. The arguments will be heard by the Supreme Judicial Court, and will relate to a referendum to change the state’s constitution to define marriage as the union of a man and a woman.However, supporters of gay marriages have expressed concerns over the fact that citizens cannot propose an amendment just to reverse a court ruling, and that the question should not have been certified for the 2008 ballot by the state’s attorney general.
Gary Buseck, legal director of Gay & Lesbian Advocates & Defenders, which filed the lawsuit, stated: "The people shouldn't be able to directly attack an SJC decision.'' Assistant Attorney General Peter Sacks argued "This amendment does not put the people in the position of declaring the Goodridge decision wrong.''
Sacks states that the ruling will not be reversed by the amendment, nor would existing marriages be invalidated. He stated that the amendment, if approved, would affect future gay marriages.
