Death Of Seventh Grader In 1997 Finally Settled
In 1997, a Florida Power and Light employee disabled a traffic signal and failed to inform police. This resulted in an auto accident that took the life of twelve-year-old Jill Golderberg. Ever since that time, the parents of the seventh grader have been fighting for justice and compensation, and the Florida Supreme Court has finally brought the matter to an end by concluding that Florida Power and Light is deemed responsible for the accident and therefore, the death of the young girl. The accident took place on September 12th, 1997.The company has been ordered to pay the parents of the deceased girl $10 million, and the couples’ attorney has stated that the result is a victory for the Goldbergs. ''This is a big victory for the Goldbergs and the general public as well. It says that utilities like FPL can't create a danger zone for the public, neglect to alert authorities and then say they're immune if a tragedy occurs.''
There was a jury award of $37 million made to the couple ion 1999. However, this was overturned by the Third District of Appeal, which led to the case being taken to the Supreme Court. The most recent decision, and one that ends this case successfully for the Golderbergs, ended with a unanimous decision to overturn the appellate decision. This conculdes a very stressful and difficult time for the parents of the girl that was killed.
The lights were not turned off by FPL intentionally. Workers had shut off the power to a power line due to damage caused by bad weather. It was during this process that the power to the traffic siganls was also inadvertently cut, resulting in the accident and death.
