Federal Judge Rules In Favor Of Challenge Against Ephedra Ban
Ephedra is a weight loss supplement that has been linked to a number of side effects and problems. The health problems that have been associated with Ephedra include increased heart rate, and blood pressure problems and there have been a number of Ephedra linked deaths. The FDA placed a ban on supplements containing Ephedra a year ago, but it now seems that the direction of the wind with regards to the ban could change.A Utah supplement company recently questioned the ban imposed by the Food and Drugs Administration, arguing that people had been taking Ephedra for centuries. And to the horror of anti-Ephedra groups, a Federal Utah judge has struck down the FDA’s ban on the product, seen by many as a reversal on the ban. One lawyer simply stated, "the ban is gone."
No decision has been given by the company with regards to when or whether the products will be back on the shelf for sale. The order made by the judge means that the FDA cannot stop the supplement company from selling its products, and the decision on the ban will be reverted back to the FDA for an assessment of what might be considered safe levels of Ephedrine.
The judge disagreed with the FDA’s original decision to class Ephedra as a drug rather than a supplement. The judge also spoke of the FDA’s statement with regards to being unable to determine a safe level, stating, "The statement that a safe level cannot be determined is simply not sufficient to meet the government's burden."
