Microsoft Counter-Sues Lucent
Following being hit by a patent infringement lawsuit by Lucent, Microsoft has now fought back with a countersuit seeking to have the lawsuit dismissed and also accusing Lucent of violation of Microsoft patents. The patent infringement lawsuit against Microsoft was filed in April of this year, with Lucent claiming that the technology used in the Microsoft X-Box 360 violated the company’s patents.In 2003 the original lawsuit for this patent infringement was filed against Gateway and Dell, but Microsoft stepped in to help the companies to fight the case by making a declaratory judgement complaint in response to the lawsuit. The patent was then thrown out but was later amended by Lucent allowing the company to sue Microsoft directly.
Lucent alleged in its lawsuit against Microsoft that its proprietary technologies were included within the gaming console. It also amended the original lawsuit to include digital technology, which is what allowed Lucent to sue Microsoft.
Microsoft alleges in its countersuit that two of the patents from Lucent are invalid, and has also accused Lucent of infringement. Microsoft officials stated that they would have preferred negotiation from Lucent over legal action, and that they were disappointed that this had not been considered.
