Court Reinstates Wrongful Death Lawsuit
The Minnesota Supreme Court has reinstated a wrongful death case dealing with the case of a child, enabling the father of the dead child to file for compensation under the Minnesota's Child Abuse Reporting Act. The decision of the Supreme Court to reinstate the case regarding nineteen-month-old Makaio Radke overruled an earlier decision made by two other courts.The boy was killed by his mother’s boyfriend. His parents were separated and the little boy resided with his mother. However, the father of the boy was concerned about the safety of his child and tried to alert authorities to the case, stating that his son has bruises and marks on his body that indicated abuse. Protection workers are known to have visited the child at his home on three occasions and failed to put any precautionary measures into place. They were even there just hours prior to the boy’s death.
The case against the city for failure to initiate protection was dismissed last year by a lower court, and the Court of Appeals also dismissed the case. However, the judge at the Supreme Court stated, "We have significant concerns about the actions of the county and its employees and whether they protected the child as required under the statute."
The little boy, it seems, was beaten by the boyfriend of his mother while she went out shopping. He was found dead by his mother the following morning, having suffered a variety of injuries including broken ribs, a lacerated liver, and punctured lungs.
