Lawsuit Dismissed Against School
A lawsuit that was filed against Eastern Kentucky University's Model Laboratory Middle School by a former student and his parents has been dismissed by a federal judge. The lawsuit was filed back in 2003, with the former students and his parents claiming that the boy’s rights under the Americans with Disabilities Act, as well as his civil rights, had been violated by school officials due to their failure to act appropriately.The lawsuit was filed because the boy and his parents stated that he was physically and mentally abused when he was 14-years-old because of various disabilities from which he suffered, and that staff and officials did nothing to make the situation better or to protect the student.
However, late last week the judge dismissed the lawsuit against the school after the jury found no evidence of inappropriate action by any of the school administrators, staff, or other officials cited in the lawsuit. The various incidents involving the student are said to have occurred between 2000 and 2002.
An attorney for the boy and his parents has advised the family to appeal against the dismissal of the lawsuit, which is something the family will be looking into. The attorney stated: 'We think the evidence in the case is such that there should be a trial on the merits of the case.'
