Class Action Lawsuit Against Wal-Mart Certified
A class action lawsuit against corporate giant Wal-Mart has been certified by the New Jersey Supreme Court. The lawsuit, filed by employees, was previously denied class action status by a trial judge and an appellate panel. However, the lawsuit has now been revived with the Supreme Court certifying it as a class action suit.According to the lawsuit Wal-Mart, which is the nation's largest retailer, denied staff breaks for meals and rests, and made staff members work even when their hours were done. Around eighty-thousand current and former Wal-Mart employees will be part of the lawsuit.
A spokesperson for Wal-Mart expressed the company's disappointment at the ruling made by the New Jersey Supreme Court. He said: "It's our policy to pay every associate for every hour that they have worked. Any manager who disregards that is subject to discipline, up to and including termination."
According to the court the lawsuit needed to be certified as lower wage earners still working for the retailer may otherwise have been too afraid to take legal action through fear of reprisal. The judge added: "We cannot ignore the reality that if the proposed class is not certified, thousands of aggrieved employees will not seek redress for defendant's alleged wrongdoing."
