Verizon Being Sued In Wrongful Death Lawsuit
The family of a woman from Oro Grande are suing Verizon phone company after the woman died from an asthma attack with no access to a phone to call the emergency services. The phone lines for Oro Grande and the home of Vanessa Spidle, aged 35, had been knocked out by a cement company two weeks before the attack. The woman had apparently requested a cell phone from Verizon as a temporary measure while the lines were repaired, but her request was denied.On the day that she suffered an asthma attack, the woman’s family had to scour the neighborhood for a cell phone in order to call the emergency services, by which time it was too late to save her. Spidle died in front of her three daughters in 2003. Family members stated that she tried to take her asthma medication but that it did not help – their only chance was the emergency services but without access to a phone even this became only a remote chance of being able to save her.
The lawsuit is suing Verizon for both wrongful death and breach of contract for failing to supply an alternative means of communication upon request. The cement company is also being named in the wrongful death suit, as it was a company vehicle that knocked out the lines to Oro Grande in the first place. The communications manager for Riverside Cement stated, "Riverside Cement is sympathetic to the family's loss, but it's not appropriate for us to provide any comment on litigation."
