The incident occurred in upstate New York last July, after the victim, 33-year-old Grania Maggio, had been to a Dave Matthews Band concert at the Saratoga Performing Arts Center. The victim was walking back to the car with friends when she was hit by the vehicle with enough force to kill her instantly.
The parents of the deceased woman have filed a lawsuit against Alexander Bennett, who was the 31-year-old driver of the car, as well as against his father Bruce Bennett. Alcohol, marijuana, and cocaine were found in samples taken from Alexander Bennett after the accident.
The lawsuit further states that the father of the driver should not have allowed his son to drive his pickup truck while under the influence of alcohol and drugs. Three bars that served Bennett with alcohol have also been named in the suit.
