Cigarette Smoke Injury Claim Rejected
A former flight attendant that claimed she was suffering various health problems due to passive smoking on flights has had her claim rejected. Lorraine Swaty claimed that the second hand smoke that she inhaled on US Airways aircrafts over the twenty year period that she worked for them had given her chronic sinusitis.This was just one of a number of cases filed by other flight attendants for similar reasons, but in the majority of the cases heard so far the cigarette companies have won, with the attendants’ claims being rejected or dismissed.
One of the tobacco companies being sued was the Lorillard Tobacco Co. Ronald S. Milstein, senior vice president and general counsel of the company stated, "We are extremely pleased with the verdict. We look forward to continuing our defense in similar cases."
Swaty’s lawsuit was filed in 1997 as part of a class action movement, which allowed flight attendants to claim compensation from cigarette and tobacco companies for injuries caused through inhaling second hand smoke on aircraft. However, although nearly three thousand cases were filed, out of the seven heard since 2001 six have been rejected.
