Dog Attack Murder Conviction For Attorney
A California attorney has been convicted of second degree murder by a state appeals court after her huge dogs mauled and killed a neighbor in San Francisco. This followed the reversal of a previous ruling by a lower court, where the attorney was convicted of manslaughter. She was given a four year sentence after the manslaughter charges, of which she served just two.The conviction of Marjorie Knoller and her husband came in 2001. The couples’ two dogs, both weighing in at over one hundred pounds, attacked a neighbor outside her apartment. The original judge stated that a murder conviction would only be justified if the attorney knew that her dogs were capable of killing. However, the judge was asked to review that decision, stating that the owner should have known the risks and was aware of the viciousness of the dogs.
A spokesman for the state attorney’s office that appealed the original ruling stated: "It basically stands for the proposition that the decisions made by juries should not be overridden by judges except in the most unusual circumstance, and this is not one of them." The original prosecutor of the defendants stated: "It's very emotional because this was one of the most preventable murders I've ever seen. There was a meanness and sadistic quality to it. These people got a thrill because their dogs scared people."
The current attorney of the Knollers has stated that he will be asking for the case to be reconsidered by the San Francisco appeals court, or possibly the California Supreme Court.
