Parents Await Decision Over Who Can Sue For Wrongful Death Of Son
The parents of a young boy that died in foster care have each been fighting for the right to become administrator of the boy’s estate, and therefore the right to claim compensation for his death. The parents of four-year-old Dontel Jeffers have been estranged for some time, and now each claims that they have the right to claim for the boy’s death.Because the administrator of the boy’s estate will be the only one with rights to take legal action for his death, both the mother and the father are making competing claims with regards to their rights. However, it is likely that the judge dealing with the case will award the administration of the estate, and therefore the right to take legal action, with a third party. One Boston lawyer stated, "The odds are 95 percent that the court will appoint neither of them."
Dontel Jeffers had only been in his foster home for eleven days when his foster mother took him to the local hospital stating that he had hit his head and had been feeling sick. He went into arrest at the hospital and was pronounced dead shortly after. No autopsy details have yet been released, but the relations of the boy’s father state that they saw the body at the hospital and that there were bruises on his face suggesting abuse.
Both of the feuding parents are though to have led troubled lives over the past few years, and each claims that the other was an unfit parent. However, whatever the outcome, they are Dontel’s only heirs and will therefore split the proceedings from any compensation awarded.
