Fired Fire Fighter Files For Discrimination
A former fire fighter that was caught drinking while at work and subsequently fired has filed a lawsuit against the city claiming sex discrimination. Cynthia Childers claims that male fire fighters were also caught drinking on the job, but that they were disciplined rather than being fired. The lawsuit has been filed at San Francisco Superior Court.The female fire fighter claims that she was singled out when she was fired in 2002, and that many male fire fighters in the same situation have simply been allowed to continue their jobs as normal. She claims in the lawsuit that in the 1980s, the fire department brought in a policy that would give fire fighters that were under the influence of alcohol a second chance and enable them to get rehabilitation.
Her suit claims that this policy had been used to protect the male fire fighters that had been drinking, and that she was the first one to be terminated for this offense. The suit goes on to say: "By treating the Plaintiff more harshly than it treated all male members of the Fire Department who engaged in substantially similar misconduct ... defendant Fire Commission was motivated in substantial part by an intent to discriminate against the Plaintiff based on gender."
The incident occurred four years ago, and after being caught with an alcohol level that was five times the legal limit, Childers was put into administration duties. It was another ten months before she was actually fired for the offense.
