Widow Of Fire Fighter Files Wrongful Death Lawsuit
The widow of a fire fighter recruit has filed a wrongful death lawsuit against the owner of the facility where he was killed and against the city of Hialeah. The Miami-Dade recruit was killed in 2003 at Port Everglades during a training operation. The exercise entailed the simulation of a fire inside a cargo ship, and it was here that the fire fighter, 37-year-old Wayne Mitchell, became separated from his colleagues.The lawsuit claims that health and safety procedures were not adhered to during the training, and that given the blatant disregard for many regulations and safety procedures, the death of a cadet was inevitable. The lawsuit lists a long line of safety procedures that it claims were not followed, and therefore led to the death of the cadet. Nancy Mitchell, the widow of the fire fighter, has already won compensation of nearly two million dollars from Miami-Dade County, which conducted its own investigation into the apparent lack of disregard for safety procedures during the training sessions at Port Everglades.
The fire fighter’s widow has declined to comment on the case to reporters, and it has not yet been disclosed how much she is seeking in compensation on her latest lawsuit. However, he attorney has stated that it would be good if the lawsuit could help to provide further details on what actually happened on the day that Mr. Mitchell died.
