Developer Sues City Over Turning Down Project
A developer from Delta Township has sued the city over its decision to turn down a project for condos and apartments. Timothy Ellis filed his lawsuit in mid June at the Eaton County Circuit Court, asking that the decision be reversed, and that the city grants him a rezoning for his project.The lawsuit further alleges that the city violated the Open Meetings Act, and that officials discussed the rezoning case at a closed session that was called to discuss the pending litigation. Ellis owns 9.9 acres between a 24-hour store and the city’s water tower.
Ellis’ proposal was to build 136 units in total, in a mix of apartment buildings and duplex condos. However, the city turned down the proposal and asked him to scale it down.
It was recommended to the city by the Planning Commission that the project be accepted after Ellis scaled it down. However, it was still rejected on a six to one vote earlier this year.
