Attorney Being Sued Over Surrogate Birth
An attorney is being sued by an Indiana couple for failure to file important documents relating to a surrogacy case. Steven Litz, an Indiana attorney, has brokered over three hundred surrogate births. However, in this latest case the mother of the child is now refusing to give up custody of triplets, which would not have been a problem, state the plaintiffs, if the attorney had filed the necessary papers.James Flynn and Eileen Donich, aged 63 and 60 respectively, state that the papers that should have been filed would have given sold custody of the triplets to James, as his sperm was used to fertilize the egg along with the eggs of a donor. Steven Litz’s firm, called Surrogate Mothers Inc., is being accused of breach of contract and negligence by the couple. The couple also claim that they were not told that there is no way of enforcing a surrogacy contract in Pennsylvania.
Steven Litz has responded to the lawsuit by stating that it is meritless. He also claims that he did warn the couple about the lack of enforcement laws in the state, as he said he does with all clients. The surrogate mother, Danielle Bimber, was awarded custody of the babies last year. Flynn was given weekend visitation rights, but ordered to pay nearly two thousand dollars a month in child support costs.
