Award Of Over Half A Million Upheld In Favor Of Dairy Farmers
An award of over $530,000 has been upheld in a states appeal court in favor of two Marathon County dairy farmers. The two farmers claim that their cows health as well as their milk production was damaged because of a stray voltage from a power company.The Northern States Power Co. had appealed to have the original decision of the jury reversed, and the company stated that some of the questions submitted to the jury by the judge were done so in error.
The two farmers, James and Michael Gumz are said to have started noticing problems with their cows around 10 years after taking over the dairy farm. Some of the cows were dying and others were producing a poor standard of milk. Court records indicate that the farmers started noticing these problems in around 1991.
After experts told the farmers that the problems with their cows were not related to nutrition, the two of them hired an independent electrical tester who then came to the conclusion that the problems stemmed from the stray voltage.
