Murder Accessory Loses Appeal
A man accused of being an accessory to a murder several years ago has lost his appeal to the state Supreme Judicial Court. Michael Harmon was just twenty-two years of age when he helped Charles Byrd by hiding the murder weapon and then buying him hair dye so that he could disguise himself.Byrd had killed a man named Joseph Alemesis, whom he suspected of having tricked two of his friends out of around $175 worth of heroin. According to reports, after hiding the murder weapon the two of them went out shopping to buy hair dye. Police picked up Byrd, then aged nineteen, at a hotel in Bedford. Upon investigation, it soon became apparent that the man had received help from a friend – Harmon.
Byrd is now serving a life sentence for second degree murder. Harmon was later sentenced to four to five years for serving as an accessory to murder. However, he appealed this sentencing to the supreme courts. In his argument, Harmon had stated that the affidavit issued for the search warrant did not give the necessary cause to believe that the items police were looking for would be found in his property.
However, in response to this, the courts stated: "Considering the gravity of the crime and the highly inculpatory nature of the evidence to be concealed, it is reasonable to believe that the defendant and Byrd would seek to hide or dispose of items soon after the crime."
