California Department Of Insurance Being Sued
The California Department of Insurance is being sued by three insurance trade groups that want to stop the enforcement of new auto rating regulations that the groups claim will harm policyholders in the state. The three groups, which comprise the Association of California Insurance Companies, the American Insurance Association and the Personal Insurance Federation of California, filed the lawsuit last week.The lawsuit, which was filed in Sacramento Superior Court, seeks to have the regulations declared illegal and for a preliminary injunction to be granted. The three insurance trade groups represent around ninety percent of the state’s drivers, and officials from the groups claim that the new regulations will harm these policyholders.
According to the trade groups, the new regulations will entail around sixty percent of drivers in the state to pay higher insurance premiums so that the remainder can pay less.
One official stated: "Under these regulations, the state will be picking 'winners' and 'losers' and forcing insurers to charge arbitrary rates. These new regulations violate Proposition 103 because they would require insurers to charge rates that do not reflect the actual risk of loss."
