Class Action Lawsuit Rebuffed In Court
A Saskatchewan court has rebuffed a class action lawsuit that was filed against five of the country’s top cell phone companies, but the judge has left the door open for another attempt by the plaintiffs to try and sue the cell phone companies.Filed by the Merchant Law Group of Regina, the lawsuit was filed against cell phone giants Bell Mobility, Telus Mobility, Aliant Inc., Rogers Wireless Inc., Microcell Telecommunications Inc. and SaskTel. The lawsuit was turned down by Justice Frank Gerein on technical grounds according to reports.
The class action lawsuit had claimed that the cell phone companies named as defendants had charged a system access fee to customers each month, and that these fees had been misrepresented and falsely advertised.
The judge went on to state that as a result of these fees the companies had benefited from ‘unjust enrichment’, and the judge went on to state that this gave the plaintiffs grounds to file against the cell phone companies again in the future.
