Class Action Lawsuit Against HCA Dismissed
A class action lawsuit that was filed against HCA Inc. has been dismissed by a federal judge. The case against the largest for-profit hospital chain in the nation was dismissed because the judge stated that each of the cases needed to be examined on an individual basis rather than as a class action lawsuit.A lawsuit filed in April claimed that the hospital defrauded consumers, because it directed its affiliated hospitals to cut back on nursing staff to levels that were below the acceptable standard. However, the judge that dismissed the class action, Judge J. Thomas Marten, stated that the cases involve medical malpractice and are not suited to a class action lawsuit.
Marten wrote in his ruling: "The court finds that plaintiffs' claims are in reality medical malpractice claims, and are not appropriately advanced as claims for consumer protection or unjust enrichment."
A spokesperson for the HCA group stated: "We thought the lawsuit was absurd to begin with, and we are pleased the judge agreed with us." The judge ruled that HCA could not be held responsible for the cases at each of its hospitals.
