Lawyers Consider How To Charge Young Girl In Fatal Stabbing Case
City lawyers recently received a two day reprieve as they considered how to deal with a stabbing in which a nine-year-old fatally stabbed an eleven-year-old friend. Lawyers met up with Brooklyn Family Court judge, Ellen Spodek, and the hearing was adjourned. The nine-year-old girl was still being kept in custody. The young girl is said to have stabbed her friend after the two of them got into a fight over a rubber ball. Queen Washington was stabbed in the chest with a steak knife.Brooklyn police had charged the young girl with manslaughter. A family Court Division spokesperson has commented that under state law anyone under the age of thirteen cannot be charged with murder or homicide. The age of the girl was the issue presenting problems for lawyers, and this is why the Family Court judge granted a short reprieve.
Laurence Steinberg, professor of psychology at Temple University, stated: "The goal of what's going to happen in Family Court is not going to be to try to punish her. By referring her to Family Court, the state assumes there are problems in this girl's life that need to be addressed." He added: "I wouldn't be surprised if there was some combination of family neglect or mental illness at play here. Just because a nine-year-old said she did something doesn't mean it happened. Nine-year-olds can be easily coerced and talked into saying things that are not true."
