Inmate To Be Tried Again After Sixteen Years On Death Row
A Chattanooga man who has spent 16 years on death row is to receive another trial, and the date has been set for April 2006. The date was set by a Hamilton County Criminal Court judge for the inmate, being held on death row in Tennessee. Michael Lee McCormick has been on death row since 1987 after being convicted of the murder of a pharmacist.Court records state that the 53-year-old was granted a new trial in 2001 based on "ineffective assistance of counsel". McCormick stated that he was frustrated with the length of time it had taken to set the date for the new trial, stating: "I feel like I'm in ‘Alice in Wonderland’ I'm going to serve a life sentence and then have a trial."
The judge has also ruled that statements that the man made with regards to his admission of the crime to an undercover officer cannot be used in the new trial. The prosecutor in the case said that this exclusion of such statements could be devastating to the new trial. The Tennessee Court of Criminal Appeals then decided that the statements could be used.
The defense lawyer says that they will just have to find a way to deal with the overturned decision: "Our job is to explain away why he would have bragged about doing something he didn't do."
