Medical Malpractice Legislation Approved
For the third year in a row, new legislation has been approved in relation to limiting damages paid out for medical malpractice. The bill was approved 230-194 and it imposes a number of limitations. Awards for pain and suffering would be capped under the bill at $250,000. Punitive damages may also be capped at the same figure in some cases. Economic damages would not be capped.Those supporting the bill have stated that the bill will help to bring down insurance premiums, or at least to stop them from rising further. Increasing premiums have caused a number of concerns including the rising cost of healthcare, doctors having to close surgeries or move to other areas with caps already in place, and a number of other problems.
The legislation received a high level of support from republicans, as well as from agencies and professionals such as doctors, hospitals, pharmaceutical companies, and insurance agencies. There was also opposition to the bill, which was mainly from democrats, advocacy groups, and attorneys.
Democrats stated that the bill meant that the interests of the average consumer were compromised. Rep. Marion Berry, D-Ark., asked his Republican colleagues: "Are you so in bed with the drug companies and the insurance companies that you just can't pass up another opportunity to give them money?"
