Self Defense Claim Rejected After Woman Slices Off Partner’s Penis
After slicing off her ex-partner’s penis a Harris County woman’s claims of self-defense have been rejected by the jury. Instead, the woman was convicted of aggravated assault after using a knife to slice off the man’s penis. Although 49-year-old Delmy Ruiz has asked for probation, she could face up to 20 years in prison.The Assistant District Attorney on the case told the jury: "She took away everything that makes him a man. He will never get to experience sexual pleasure again. How do you assign a penalty or a value to that? You don't have the right to cut it off because you've been raped. You have the right to call the police."
The woman claimed in her defense that the ex-partner had demanded oral sex in her home and that he had raped her. The defense attorney stated to female jurors: "Imagine having sex when you don't want to. And for the men, I want each one of you to think how you would feel if you were lying on your belly while someone violated you and then he made you (perform oral sex). And there's a knife there."
The ex-partner has stated that he does not remember any assault, but simply remembers waking up on the bed and finding out what had happened in hospital.
