Boston Court Rules On Wiretapping Businessman
A Boston federal appeals court has ruled that a businessman can be charged under a federal wiretapping statute after he was found to be intercepting and reading the emails of customers. The case is actually four years old, and has captured the interest of many Internet civil liberties groups.The case is against the vice president of Interloc Inc, Bradford Councilman. The company offered a free email service for customers but in 1998 the accused allegedly started to intercept customer emails from Amazon. Colleagues of the accused were also involved, and they read the messages in order to be able to match or beat offers that Amazon was promoting to customers.
Councilman was indicted in 2001 for violation of the federal wiretapping law. However, the accused fought this because he stated that the email was not in transit when read but was stored in the computer’s memory. The courts agreed with this and therefore the indictment was thrown out. This ruling was appealed against by the US Justice Department, but was once again thrown out.
However, the case has now been heard by all seven appeals court judges, and the ruling made that he can in fact be indicted on this charges.
