Man Receives Settlement For Lawsuit Against Police
A settlement of nearly $300,000 has been paid out to a McKeesport man after he filed a federal lawsuit against Mt. Oliver Police for a traffic stop that he alleges was racially motivated. Thirty-seven year old Kenneth Huston stated that he was hurt during the incident, which took place in 2001.The lawsuit had named several Mt. Oliver police officers as defendants as well as the Mt. Oliver Borough police Chief Frank Mosesso, and the Mayor John Smith. In the lawsuit allegations were also made with regards to the standard of police training and the practices employed by officers in certain situations.
The attorney representing Mt. Oliver stated that the settlement was agreed simply to avoid having to pay more money in the event that a jury awarded even more if it went through the courts. He added that the borough had not admitted to any fault with regards to the incident.
The lawsuit alleges that the stop was made on a profile and racially motivated basis, and that the plaintiff was attacked by several officers during the incident.
